A District Court judge granted Galway City Council permission on Monday to have the owner of an adult sex cinema brought before the court tomorrow (Thursday) to give reasons why he should not be held in contempt of court.
City Council solicitor, Robert Meehan, applied to Judge Eamon O'Brien, at Galway District Court to have John Kelleher, c/o Jade Winters, Liosban Industrial Estate, Tuam Road, Galway, brought before the court tomorrow (Thursday).
Mr Meehan made the application under Section 46B of the District Court Rules to have Mr Kelleher brought before the court to show cause why he should not be committed to prison for his contempt, following his refusal to comply with an order issued by the court on 4 June last, directing him to close the adult cinema.
Judge Mary Fahy had issued a court order on 4 June last directing Jade Winters, which is located in the Liosban Industrial Estate, to close and remove signage from its premises after city council planners told her the premises was operating without planning permission. However, Mr Kelleher, who owns the business, failed to comply with the court order and the city council instigated proceedings yesterday to have him brought back before the court for contempt of the closure order.
Mayor Padraig Conneely first highlighted the presence of the adult sex cinema at a city council meeting in May, calling for the immediate closure of the "lurid" sex cinema.
The 24-seater cinema is located behind the Jade Winters sex shop and patrons pay €12 admission.
