It was a case of "let sleeping dogs lie" for a man who this week withdrew a complaint about his neighbour's dogs, which he had made earlier this year due to their constant barking. Noel Kelly, of 151 An Sean Bhaile, Doughiska, had initially made a complaint under Section 25(2) of the Control of Dogs Act 1986, because of the excessive barking of dogs owned by his next-door neighbours, Helen and Stephen Brennan, of 152 An Sean Bhaile, Doughiska. The matter first came before Galway District Court on 28 February last, when Mr Kelly complained that the dogs barked both day and night. At the time his neighbours undertook to stop their dogs barking and the matter was adjourned until his week's court for review. Mr Kelly told Judge Mary Fahy this week that the nuisance had abated and he now wished to withdraw his complaint as the dogs no longer barked at night-time. He said he could live with the fact that they still continued to bark during the day, even though he would prefer if they didn't and he said he wanted to withdraw the complaint as his neighbours were involved. Striking the matter out, Judge Fahy advised Mr Kelly that if the dogs started to bark at night again, there was nothing to stop him from making a fresh complaint. She said that as the parties involved were neighbours, she hoped they could sort something out between them outside court. |
