Man 'arrested for own safety' E-mail

A Ballybane man who was "arrested for his own safety" at the Spanish Arch on 24 March, was this week convicted of two charges of public drunkenness and one charge of trespass at Galway District Court.

Thomas McCarthy (44), formerly of 12 Hillside, Ballybane but now living in the Fairgreen Hostel, was charged with two counts of being intoxicated in a public place, one offence of criminal damage, and one offence of trespass in a manner likely to cause fear to another person.

Defence solicitor Valerie Corcoran told presiding judge Aeneas McCarthy that this was the "same old story", that her client was addicted to alcoholism, and that his alcoholism was the root of his problems. Ms Corcoran informed the court that her client was poorly educated, and had lost members of his family to alcoholism.

Ms Corcoran also claimed that her client was not present in court as he had been under the influence when receiving his charge sheet, and could not remember the court date.

Judge Aeneas McCarthy fined the defendant €120 each for the charges of public drunkenness, giving him one month to pay. The charge of criminal damage (arising from Mr McCarthy's alleged conduct while in Garda custody) was dismissed, while the trespass charge was taken into consideration by the court.

Mr McCarthy was also facing charges in Limerick, the court learned, and would be remanded back to Limerick District Court to face that charge.
