Judge warns man not to go into Tesco with drink taken E-mail

A Galway City resident who had pleaded guilty to being intoxicated at Tesco decided to contest the matter at Galway District Court this week.

Krzysztos Niewolksi, (25), with an address at 36 Tirellan Heights, Headford Road, was charged with being intoxicated, and using or engaging in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace at Tesco, Galway Shopping Centre on 21 January last. A Garda told the court that he got a call to go to Tesco. There he spoke to two members of the security staff. They informed him that the defendant was trying to get into the alcohol section, which was caged off. He tried shaking the case. Mr Niewolski was intoxicated and the witness directed him on three occasions to leave the premises. It was 4.03am. The court heard that the defendant runs his own construction company.

Mr Niewolski told the court that he was walking by the cage and touched it. He was on his way home from the pub but wasn't drunk. The defendant said he was buying something to eat. He added that both he and the security guard called the Gardaí. Niewolski said that he wasn't treated properly by the security staff and the Gardaí.

The Garda asked the security man what happened but did not ask him. He wanted to know why he could not purchase his goods and the Garda told him he better go. He has no previous convictions and is three years in Ireland. The Garda witness said that the defendant was well intoxicated and was asked a number of times to leave.

"I wouldn't advise you to go into Tesco with drink taken," Judge Fahy advised him. "If a member of An Garda Siochana asks you to leave, you should leave." Judge Mary Fahy remanded the defendant on continuing bail to 12 September next.
