Assault accused not in court because before Central Criminal Court E-mail

A Galway City man who is charged with assaulting two gardaí and two other people in separate incidents last year was not able to appear before Galway District Court last Monday in relation to the charges because he was due to appear before the Central Criminal Court instead.

Gerard Barry (27), of 65 St James Crescent, Mervue, Galway, with an address at 213 Tur Uisce, Doughiska, Galway, faces charges of assaulting Garda Jason Kelly and Sergeant John McElroy at Eyre Square, Galway, on 31 March last and with being drunk in public, on the same date. He is further charged with breaching the peace and with failing to obey the directions of Garda Kelly and leave the area, also on the same date.

Barry is further charged with contravening a Protection Order, on 16 August last year, which a woman had obtained against him. He was charged with contravening the order by putting the woman in fear when he called to her house in the early hours of the morning. He is also charged with assaulting the woman on 3 August last and with assaulting a male, on the same date.

Bail had been granted to Barry on 19 August last year at a special court sitting, on condition he stay away from the woman, keep the peace and be of good behaviour and sign on daily at Salthill Garda Station.

The charges had been adjourned on a number of occasions in the interim and were back before the court this week for mention only. Inspector Pat McHugh said Barry was not present in court because he was due to appear before the Central Criminal Court in Dublin. He applied to have the charges before the District Court adjourned to July.

Defence solicitor, Olivia Traynor said the State did not want to deal with these charges until the other matter had been dealt with by the Central Criminal Court.

Judge Mary Fahy said that while Barry was in custody on the other matter he had been granted bail on the charges before her court. She remanded him on continuing bail on those charges to 21 July when the matter will be back before her court again for mention only.
