'Stroke' Fahy judgment expected today E-mail

The judgement of the Court of Criminal Appeal in the case of disgraced Councillor Michael 'Stroke' Fahy is to be announced today.

The decision of the three-judge court was due to be read out yesterday but was delayed for "administrative reasons", according to a spokesperson for the Courts Service.

Cllr Fahy is currently serving a 12-month jail term at Castlerea Prison for fraud and attempted theft. He is due for release in January. The Ardrahan man's appeal is based on the fact that his defence team were not made aware in advance of evidence given by a prosecution witness during the trial.

The now Independent Councillor, previously a member of Fianna Fáil, kept his seat on Galway County Council as a result of a unanimous vote by his fellow county councillors to deem him ill and away on business. Councillors absent for six months from meetings can only keep their seats if they are deemed to be ill or have missed meetings "in good faith". If Cllr Fahy's appeal is unsuccessful, he will have to resign from his seat.
